Booking Terms & Conditions

1. Introduction

These Booking Terms & Conditions govern all direct bookings made with Tommaso Sacchi, trading as Torre di Sopra ("we", "our" or "us"), for stays at Torre di Sopra.

By confirming a booking, the lead guest confirms that they have read, understood and accepted these Terms & Conditions on behalf of all members of their party.

Bookings made through third-party platforms, including Airbnb, VRBO and Landfolk, remain subject to the applicable terms and conditions of those platforms where relevant.

2. Booking Confirmation

A booking becomes confirmed only when:

  • we have accepted the reservation in writing; and

  • the required deposit or payment has been received.

Until both conditions have been met, availability cannot be guaranteed.

3. Payments

The payment schedule applicable to your booking will be confirmed at the time of reservation.

Unless otherwise agreed in writing:

  • the initial deposit secures the reservation;

  • the remaining balance must be paid by the due date stated in the booking confirmation.

Failure to make payment by the due date may be treated as a cancellation by the guest.

Any bank transfer charges are the responsibility of the guest.

4. Security Deposit

A refundable security deposit or credit card pre-authorisation may be required before arrival.

The amount and method will be confirmed during the booking process.

We reserve the right to retain part or all of the security deposit to cover:

  • damage to the property or its contents;

  • excessive cleaning;

  • missing items;

  • breaches of these Terms & Conditions or the House Guidelines.

Any unused balance will be released as soon as reasonably possible after departure.

5. Cancellation by the Guest

All cancellations must be made in writing.

The cancellation policy applicable to your reservation will be confirmed at the time of booking and forms part of the booking agreement.

Where possible, we will always endeavour to re-let cancelled dates. Any refund remains at our discretion unless otherwise required by law or expressly agreed.

We strongly recommend that guests obtain comprehensive travel and cancellation insurance.

6. Cancellation by Us

If, for reasons beyond our reasonable control, we are unable to honour a confirmed booking, we will refund all monies paid.

Such refund shall constitute our full liability, except where otherwise required by applicable law.

7. Guest Registration and Occupancy

The maximum number of guests specified in the booking confirmation must not be exceeded.

Only registered guests may stay at the property unless agreed in writing beforehand.

In accordance with Italian law, all guests must provide the information necessary for registration with the competent authorities before or upon arrival.

8. Arrival and Departure

Check-in and check-out times are confirmed before arrival.

Early check-in or late check-out may occasionally be possible but cannot be guaranteed and may incur an additional charge.

9. Historic Property

Torre di Sopra is a historic property dating back almost one thousand years.

Guests acknowledge that the house includes uneven floors, historic staircases, terraces, level changes and architectural features that cannot be altered to modern standards.

The lead guest accepts responsibility for ensuring that all members of their party exercise appropriate care throughout their stay.

10. House Guidelines

Guests agree to comply with the Torre di Sopra House Guidelines, which form part of these Booking Terms & Conditions.

Failure to comply with the House Guidelines may result in additional charges or, in serious cases, termination of the stay without refund.

11. Guest Responsibilities

Guests agree to:

  • treat the property, furnishings and gardens with care;

  • respect neighbours and the surrounding countryside;

  • report any damage or maintenance issues promptly;

  • ensure that all members of their party comply with these Terms & Conditions and the House Guidelines.

The lead guest remains responsible for the conduct of all members of the booking throughout the stay.

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where this results from circumstances beyond our reasonable control, including but not limited to:

  • natural disasters;

  • severe weather;

  • wildfire;

  • utility failures;

  • strikes;

  • governmental restrictions;

  • acts of terrorism;

  • pandemics or other public health emergencies.

13. Insurance

Guests are responsible for arranging appropriate travel, medical and cancellation insurance.

We also recommend insurance covering accidental damage and personal belongings.

14. Limitation of Liability

Nothing in these Terms & Conditions limits or excludes liability where such limitation is prohibited by applicable law.

Subject to applicable law, our liability is limited to losses that are the direct and foreseeable consequence of our breach of contract or negligence.

We are not responsible for:

  • interruptions to utilities or internet services beyond our reasonable control;

  • the acts or omissions of independent third-party service providers;

  • loss of or damage to personal belongings unless caused by our negligence.

15. Privacy

Any personal data collected during the booking process will be processed in accordance with our Privacy Policy and applicable data protection legislation.

16. Governing Law

These Booking Terms & Conditions are governed by the laws of Italy.

Any dispute arising from a booking shall be subject to the exclusive jurisdiction of the Italian courts.
